The APA requires that the ALJ be separate from the investigative and prosecutorial staff. The APA also prohibits its ex parte (private) communications between the ALJ and the company involved. Finally, provisions of the APA protect the ALJ from agency disciplinary actions unless the agency can show good cause for such an action
