Agencies are most time limited in their power to admit evidence in the form of testimony. in order to be lawful they must:
-Prove the investigation is legitimate
-Prove the agency has the power to conduct investigation
-Describe the requested information, -Explain the relationship between purpose and requested information -Show the information doesn’t create an unreasonable burden on the business or individual.
